Terms of service
Effective October 23, 2026
Our agreement
These terms are the agreement between your business and Housecall Growth (“we”, “us”). They apply when you sign up online (by ticking the box that you agree), accept a proposal or quote, pay our first invoice, sign in to the client portal, or otherwise start a service with us, and they also cover use of this website. Our refund policy is part of these terms.
If we both sign a separate agreement, it wins where it conflicts with these terms. An approved proposal or quote wins on its own scope, price and timeline. Otherwise these terms apply.
Who our services are for
Our services are for businesses, not personal or household use. By accepting these terms you confirm you're at least 18 and authorized to bind the business you represent.
What's included
- Each monthly plan includes what the pricing page lists for it on the day you sign up, including any monthly limits and the calls and texts allowance. Plans aren't unlimited.
- Additional services and custom projects are separate and include what their page or your quote describes. You can buy them without a plan.
- Unused monthly work and allowances don't roll over.
- Work outside your plan is always quoted and approved by you before we start.
How we do the work
We use software and AI tools, including AI assistants, to research, write, build and organize your work. A person at our business directs and reviews it, and we're responsible for what we deliver to you just as if we'd done every step by hand. We may use trusted contractors or software providers to help, and we're responsible for their work too.
Fees, payment and automatic renewal
- Prices are in US dollars and don't include taxes, which you pay where they apply.
- Card on file. You pay by card when you sign up, through our payment processor (Stripe). By signing up you authorize us to charge that card, or any card you later give us, for every renewal and for anything else you order, until you cancel.
- Automatic renewal. Monthly plans and monthly services renew every month. Annual plans renew every 12 months. Each renewal is charged in advance on the renewal date, until you cancel as described below.
- On monthly billing, the one-time setup fee is charged at sign-up. It's waived on annual billing.
- Annual billing is 12 months of service for the price of 10, paid in advance. With an annual plan, monthly services are billed separately each month.
- Website builds are paid half at sign-up and half at launch, charged to your card on file.
- Ad management fees are based on the monthly ad or lead spend you choose, as explained on each service's page. If you change your budget, the new fee applies from your next billing date.
- Calls, texts and AI answering minutes above your allowance are billed as set out on the pricing page.
- Ad spend, domain names and software you choose to buy are paid by you, directly to the provider where possible.
- If a payment fails, we try again over the following days and email you a link to pay. If it's still unpaid after 7 days, we may pause work. Paused time doesn't extend what you've paid for.
- If you think a charge is wrong, tell us within 30 days and we'll sort it out with you.
- We never see or store your full card details. Our payment processor does.
Price changes
We may change prices with at least 30 days' written notice. A new price applies from your first renewal after the notice ends. Annual plans keep their price until renewal, and approved quotes keep theirs.
Changing plans and cancelling
Moving up a plan takes effect immediately. We charge the difference in price for the time left in your current billing period (the new price minus the old price, multiplied by the share of the period that's left), and the new price from your next renewal. Switching from monthly to annual billing starts a new 12-month term that day, with credit for the unused part of your current month.
Cancelling, moving down a plan, switching from annual to monthly billing, or removing a service takes effect at your first renewal that is at least 30 days away. If you make the change less than 30 days before a renewal, that renewal still happens and is charged, and the change takes effect at the end of the renewed period. You can make these changes in your client portal or by emailing us.
Annual plans are a 12-month commitment. They can't be cancelled for the current term. We email you 90 and 60 days before each renewal; to stop a renewal, cancel at least 30 days before it.
Cancelling stops future charges. You keep your service until the end of the period you've paid for, and nothing already paid is refunded.
Refunds
All payments are final and non-refundable, as set out in our refund policy, which is part of these terms. The only exceptions are billing mistakes, services we end or can't provide, and refunds the law requires.
When service ends
We may end a service with 30 days' written notice for any reason, or sooner if an invoice is more than 30 days overdue, if you seriously break these terms and don't fix it within 10 days of notice, or if you ask us to do something unlawful or deceptive.
When a service ends, for any reason:
- Within 14 days we hand over everything that's yours: logins we set up, files, content, reports and data exports.
- We remove our own access to your accounts, and you should change any shared passwords.
- If we host your website, it stays online for 30 days so you can move it, and we give you a full copy.
- Any unpaid fees for work done or notice periods become due.
Your responsibilities
- Give us the access we need (for example manager access to your Google Business Profile, never your password), accurate information about your business and timely approvals. Delays on your side can delay the work.
- Only give us content (photos, logos, text, customer lists) you have the right to use, and keep claims about your licenses, insurance, warranties and prices accurate.
- Follow the laws that apply to your business, including advertising, licensing and consumer laws.
- Review what we publish for you when we ask. You're responsible for the accuracy of facts only you can know.
Monthly work and approvals
- Setup. During setup we agree your first month's plan with you, along with a library of approved responses (review replies, missed-call texts, review requests and follow-up messages) written in your voice with your input.
- Everyday messages. Messages from that library are sent automatically without separate approval. Before replying to a serious negative review (for example one that is abusive, makes accusations or involves a billing, safety or legal dispute), we send you a suggested reply and wait for your answer. You can change the library at any time.
- Monthly work. We complete the month's work that will be published for you, such as Google posts, new pages, campaigns and ads, within the first two weeks of the month and send it to you for approval in your client portal, together as one batch where we can.
- Approval window. You have 7 days to approve the work or ask for changes. We make the changes you ask for and send the work back for approval.
- No response. If you don't respond within 7 days, the work is held and none of it is published that month. We review it with you at your next monthly strategy call, or with the following month's plan if your plan doesn't include one, and publish it once you approve it. Held work counts toward the month in which we did it: it doesn't carry forward as unused allowance, extend your plan, or entitle you to a refund or credit.
- Automatic approval. You can turn on automatic approval in your client portal. We then publish each month's work without waiting for your answer and email you a copy, and you can still ask for changes afterward.
- Your requests. Changes you ask for, such as new hours, photos or prices, count as approved when you send them.
Texts, calls, recordings and AI answering
Some services send texts or emails and answer, track or record calls on your behalf. Your business is the sender and the business your customers are dealing with, so:
- You're responsible for having your customers' consent where the law requires it before they get texts or automated messages, and for honoring opt-outs. We build every flow with an opt-out and only message people who contacted you or are your customers.
- Carriers require business texting to be registered. You agree to provide accurate details for that registration.
- Marketing messages to your past customers (past-customer marketing) are sent by email, and by text only to customers who have given the prior written consent the law requires for marketing texts. You confirm that the customer lists you give us were collected lawfully and tell us which customers agreed to texts. Every email includes an unsubscribe link, and we honor opt-outs promptly.
- Some states require everyone on a call to agree to recording. Where calls are recorded, callers hear a notice first, and you agree not to ask us to remove it.
- AI phone answering tells callers it's an AI assistant, follows the instructions you approve, and passes calls to you as agreed. It can make mistakes, and it isn't an emergency service: your greeting should tell callers with emergencies what to do.
- We can't guarantee every call, text or email is delivered, answered or transcribed correctly.
Reviews
We ask all your customers for reviews in the same way, never just the happy ones. We don't write, buy or offer rewards for reviews, and we don't hide or suppress genuine ones. Federal law and Google's rules prohibit these practices, and you agree not to ask us to do them. See our acceptable use policy.
Advertising
- Ad accounts (Google Ads, Local Services Ads, and Facebook and Instagram through Meta) are in your name, you own them, and ad spend is charged by Google or Meta to your payment method.
- We keep campaigns within the monthly budget you approve. Google may spend more than the daily budget on some days and balances it over the month; we don't control that, and Google's billing applies.
- Ads must follow the platform's policies, and Google or Meta decides what it approves, how it charges and whether to credit invalid clicks or leads.
Google profile suspension recovery
- Recovery is a fixed fee for the work: diagnosing the likely cause, fixing what breaks Google's guidelines, preparing your evidence, filing the appeal, following up, and one further appeal if Google turns down the first and there's new evidence to send.
- Google alone decides whether a profile is reinstated and how long that takes. We don't guarantee reinstatement, and the fee isn't refunded if Google keeps the suspension.
- You agree to give us accurate information and genuine documents, and to complete steps only you can do, like a verification video. We won't create a replacement profile to get around a suspension, use a false address or submit altered documents.
- If a change we made to your profile causes a suspension, we handle the recovery at no charge.
Websites and hosting
- Your domain name stays registered in your name, or we transfer it to you on request.
- Monthly plans and website care require your website to be on WordPress, on our hosting or yours. On your own hosting you give us admin access, and your host is responsible for its speed, uptime and charges. Moving a WordPress site to our hosting is free. A site on Wix, Squarespace or another builder must first be rebuilt on WordPress from its current text and photos, a separate one-time fee shown in your order before you pay. If your site's platform turns out to be different from what you told us, see our refund policy.
- If we host your website, we keep it updated, secured and backed up as part of website care. We aim for it to be online at all times but can't promise it, and our hosting provider's outages are outside our control.
- Business email included with website care is set up in your name with Google Workspace or Microsoft 365. We pay for one address while you have website care; if it ends, the account stays yours and you take over its bill. The email provider's outages and policies are outside our control.
- Keep your own copy of anything you can't afford to lose. We give you a copy whenever you ask.
Ownership
You own your website, domain, accounts, data, and the content and designs we create for you once they're paid for, and you keep them if you leave.
We keep our own tools, templates, code libraries and know-how, and you get a permanent, royalty-free license to use anything of ours built into your work. Third-party software, fonts and stock media stay under their own licenses. You give us permission to use your content only to provide our services.
We only name you or show your work publicly with your written permission. If someone claims something we made for you infringes their rights, we'll replace or change it at no charge.
Third-party platforms
Google, phone carriers, website hosts, CRMs and other platforms can change their rules, suspend accounts or go down without notice. We can't control them, but we'll tell you about anything that affects your results and help you respond.
Confidentiality
Each side keeps the other's non-public business information confidential and uses it only for our work together, unless it's already public, received independently, or must be disclosed by law. This lasts for 3 years after our work ends, and for as long as the law protects it in the case of trade secrets and personal information.
Your customers' information
When we handle personal information about your customers (for example names, phone numbers, messages or call recordings), we do so on your behalf as your service provider. We:
- use it only to provide our services to you, and never sell or share it for advertising;
- don't combine it with information from other clients;
- protect it with reasonable security and limit access to what the work needs;
- help you respond to customer requests to access or delete their information;
- tell you without undue delay if we learn it's been accessed without permission; and
- delete or return it within 60 days after our work ends, except copies the law requires us to keep or that sit in routine backups until they expire.
Our privacy policy explains how we handle information about you and visitors to this website.
Client portal
Keep your portal login private and tell us straight away if you think someone else has used it. You're responsible for activity under your login. We may suspend access to protect your account or our systems.
Fixes
If something we built doesn't work as agreed, tell us within 30 days of delivery (or the period in your quote) and we fix it at no charge. While you're on a plan, we keep fixing problems in work we did under it. New requests, and problems caused by changes made by you or third parties, are separate.
No guaranteed results
We do the agreed work with care and report honestly on it. Rankings, calls, leads and revenue depend on things we don't control, like Google, competitors, your market and how you follow up, so we don't guarantee them.
Disclaimer
Except for what these terms expressly promise, our services, deliverables and this website are provided “as is”. To the extent the law allows, we disclaim all other warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the extent the law allows:
- Neither side is liable for lost profits, lost revenue, lost data or any indirect, special or consequential losses.
- Our total liability for all claims is limited to the fees you paid us in the 3 months before the event that caused the claim.
- These limits don't apply to your obligation to pay our fees, to the indemnity below, or to fraud or wilful misconduct, and don't limit any liability the law doesn't allow to be limited.
Indemnity
You'll cover our reasonable costs, including legal fees, if someone makes a claim against us because of content or instructions you gave us, your products or services, or your failure to get consent or follow the law as these terms require. We'll tell you promptly about any such claim and let you control its defense.
Using this website
The information on this website is general and may change; your proposal or quote sets out what you're actually buying. Links to other sites are for convenience and we aren't responsible for them. Please follow our acceptable use policy.
Disputes
If something goes wrong, tell us in writing and we'll both try in good faith to resolve it within 30 days before anyone goes to court. Either side can still take a claim to small claims court, or ask a court for urgent relief, at any time.
These terms are governed by the laws of the State of Texas. Disputes that aren't resolved go to the state or federal courts serving the Texas county where we have our principal place of business, and each side brings claims only on its own behalf, not as part of a class action. Any claim must be brought within 1 year after it arises, unless the law requires a longer period.
General
- We're independent businesses. Neither side can make commitments for the other.
- Notices can be sent by email to the address each side last gave the other. Accepting a quote or these terms electronically is as binding as signing on paper.
- Neither side is responsible for delays caused by events outside its reasonable control, such as outages, natural disasters or platform failures. This doesn't excuse paying for work already done.
- Neither side may transfer this agreement without the other's consent, except as part of selling its business.
- If part of these terms can't be enforced, the rest still applies. Not enforcing a term right away doesn't waive it.
- Sections that by their nature should last after our work ends (such as fees owed, ownership, confidentiality, data, liability, indemnity and disputes) continue to apply.
- These terms, together with any signed agreement and approved quotes, are the whole agreement between us on this subject.
Changes to these terms
We may update these terms; the date above shows the current version. For existing clients, we email you about any significant change at least 30 days before it applies. If you're on a monthly plan and don't agree, you can cancel before it takes effect without paying for a notice period. Annual plans keep the terms they started with until renewal. Changes never alter a signed agreement unless we both agree in writing. Questions? Contact us.
